This website is jointly operated by two companies. They are jointly responsible for the processing activities described below (Art. 26 GDPR):

BRAIN Biotech AG
Darmstädter Straße 34–36
64673 Zwingenberg
Germany
Phone: +49 6251 9331-0
Email: info@brainbio.com
Represented by the Management Board: Dr. Sven K. Weber (CEO), Michael Schneiders
Commercial Register: Local Court of Darmstadt, HRB 24758

Biocatalysts Ltd

United Kingdom
Phone: +44 1443 843712
Email: enquiries@brainbio.com
Represented by: Johan Jansén-Storbacka
Registered in England and Wales, Company No. 2570883

What we are jointly responsible for: providing and operating the website, including server log files and delivery via a Content Delivery Network (Section 3), the website search (Section 4), receiving your inquiries (Section 5), the consent tool (Section 6), and the analytics and marketing services (Section 7).

What each company is solely responsible for: handling the content of your inquiry. As soon as your inquiry has been assigned to the company responsible for your matter, that company processes your data under its own responsibility.

Allocation of responsibilities: We have specified in an agreement which party fulfills which obligations under the GDPR. The key points are:

  • BRAIN Biotech AG is the central point of contact for all questions regarding data protection and for exercising your rights.
  • Biocatalysts Ltd is responsible for the consent tool (cookie banner). It manages Google Tag Manager and the analytics and marketing services integrated through it and analyzes the statistics.
  • Inquiries submitted via the contact form are handled by the company responsible for your matter.

Regardless of this agreement, you may exercise your rights against either of the two companies (Art. 26(3) GDPR).

2. Data Protection Officer

BRAIN Biotech AG has appointed a Data Protection Officer.

Email: privacy@brainbio.com
Mail: BRAIN Biotech AG, Data Protection Officer, Darmstädter Straße 34–36, 64673 Zwingenberg

3. Accessing the Website and Server Log Files

What data: When you access our website, the web server automatically processes data transmitted by your browser. This includes in particular:

  • IP address,
  • date and time of access,
  • page or file accessed,
  • previously visited page (referrer),
  • browser type and version, as well as operating system.

This data is stored in log files.

Purpose: We process the data in order to deliver the website to you and ensure its stable and secure operation.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest is the secure and functional operation of the website. Without your IP address, the website technically cannot be delivered to your browser.

Recipients: The website is operated in a data center in the EU.

Retention period: We delete the log files after 14 days. We retain individual entries for a longer period only if we need them to investigate a specific security incident.

Delivery via a Content Delivery Network (Cloudflare)

We deliver the website via Cloudflare’s Content Delivery Network (CDN). A CDN is a network of servers that caches content and delivers it from a location near you. Your request to access the website is therefore routed through Cloudflare servers.

What data: Your IP address and the access data listed above.

Purpose: Short loading times and stable, secure delivery of the website.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest is the fast and reliable provision of the website.

Recipient: Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA, as a processor. Cloudflare stores the data in the European Union. For transfers to the USA, see Section 11.

4. Website Search

If you use our search function, we process your search term in order to display relevant results. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is to make it easier for you to find content. We do not store your search term beyond the server log files (Section 3) and do not analyze it.

5. Contact Form and Contact by Email or Phone

What data: In the contact form: first name*, last name*, job title, company, email address*, phone number, and your message. Fields marked with * are required because we need them to assign and respond to your inquiry. If you email us or call us, we process your contact details and the content of your communication.

Spam protection: To protect the form against automated submissions, we use the captcha.eu service. When the form is submitted, it checks whether the input was made by a human. In doing so, your IP address and technical information about your browser are processed. The provider is captcha.eu: Captcha GmbH, Muthgasse 2, 1190 Vienna, Austria; it acts as a processor on our behalf. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is protecting the form against misuse.

Purpose: We process your information in order to handle and respond to your inquiry. Your inquiry is handled by the company responsible for your matter (Section 1).

Legal basis:

  • Art. 6(1)(b) GDPR if your inquiry is aimed at entering into a contract, for example a product or project inquiry, or concerns an existing contract.
  • Art. 6(1)(f) GDPR in all other cases, including when you contact us as a representative of a company. Our legitimate interest is communicating with prospective customers, customers, and business partners.

6. Consent Tool (Cookie Banner)

When you first visit our website, we ask you in a banner whether you consent to analytics and marketing services. You can consent to all services, reject them, or select them individually. We store your selection in a cookie (Section 9) and document it so that we can demonstrate your consent.

Legal basis: Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR (obligation to demonstrate consent). The cookie is technically necessary (Section 25(2) No. 2 TDDDG).

Retention period: We retain proof of your consent for 1 year.

7. Analytics and Marketing Services

Only with consent: We use the following services only if you consent to the relevant category in the cookie banner. Without your consent, they remain disabled.

Google Tag Manager

We integrate the services through Google Tag Manager. Tag Manager controls which services are loaded in accordance with your selection in the cookie banner. It does not itself analyze any data. When Tag Manager is loaded, your IP address is transmitted to Google.

Analytics

If you consent to “Analytics,” we measure how our website is used, for example which pages are accessed and how visitors arrive at our website. We use the results to improve the content and structure of the website. The analysis is performed by Biocatalysts Ltd.

What data: Online identifiers from cookies, pages accessed, interactions, device and browser information, IP address.

For all services in this section

Legal basis: Your consent (Section 25(1) TDDDG; Art. 6(1)(a) GDPR). You may withdraw it at any time via the cookie settings (Section 9).

Retention period: The lifetimes of the cookies and storage entries can be found in Section 9. Google determines how long it retains the transmitted data beyond these periods.

8. Links to Social Networks

On our website, we link to our profile on LinkedIn (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland). This is a simple link. Data is only transmitted when you click the link; LinkedIn’s Privacy Policy then applies: LinkedIn Privacy Policy

9. Cookies and Similar Technologies

We distinguish between technically necessary cookies, which we may set without consent (Section 25(2) No. 2 TDDDG), and cookies or access to stored information that we use only with your consent (Section 25(1) TDDDG).

Technically necessary

Only with consent

Category Provider Purpose Storage type and duration
Analytics [ANALYTICS SERVICE: Provider] Distinguishing visitors, measuring website usage Cookies; up to 2 years
Marketing Google (Ads) Conversion measurement and remarketing Cookies; up to 90 days. Local Storage; until deleted by you

Withdrawal: You can withdraw your consent at any time. You can delete or block cookies in your browser.

10. Overview of Recipients

Within the two companies, your data is only provided to employees who require it for their duties. BRAIN Biotech AG and Biocatalysts Ltd exchange data with each other to the extent necessary to handle your inquiry or enable you to exercise your rights.

We also use service providers for hosting, website delivery (Content Delivery Network), and spam protection. They process the data only on our instructions as processors. With your consent, Google also receives data under its own responsibility (Section 7). For transfers to third countries, see Section 11.

11. Transfers to Third Countries

  • United Kingdom: Biocatalysts Ltd is based in the United Kingdom. Transfers between BRAIN Biotech AG and Biocatalysts Ltd are covered by an adequacy decision of the European Commission for the United Kingdom (Art. 45 GDPR).
  • USA: The following recipients are based in the USA or may access data from there: Cloudflare, Inc. (Section 3; the data is stored in the EU) and, only with your consent, Google LLC (Section 7). The transfer is based on the European Commission’s adequacy decision concerning the EU-US Data Privacy Framework (Art. 45 GDPR); the recipients named above are certified under this framework.

12. Obligation to Provide Data, Automated Decision-Making

You are neither legally nor contractually required to provide us with data. Without your IP address, we cannot display the website to you. Without the required information in the contact form, we cannot respond to your inquiry.

We do not make automated decisions within the meaning of Art. 22 GDPR.

13. Your Rights

You have the following rights:

  • Access (Art. 15 GDPR),
  • Rectification of inaccurate data (Art. 16 GDPR),
  • Erasure (Art. 17 GDPR),
  • Restriction of processing (Art. 18 GDPR),
  • Data portability (Art. 20 GDPR) for data that you have provided to us on the basis of consent or a contract,
  • Withdrawal of consent with effect for the future (Art. 7(3) GDPR), and, for cookies, via the cookie settings (Section 9). Processing carried out before withdrawal remains lawful.

To exercise these rights, contact privacy@brainbio.com. You may exercise your rights against either of the two controllers.

Right to Object (Art. 21 GDPR)

Where we process your data on the basis of Art. 6(1)(f) GDPR (Sections 3 to 5), you may object at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.

Was jedes Unternehmen allein verantwortet: die inhaltliche Bearbeitung Ihrer Anfrage.

  • IP-Adresse,
  • Datum und Uhrzeit des Zugriffs,
  • aufgerufene Seite bzw. Datei
  • zuvor besuchte Seite (Referrer),

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO.

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO.
